Terms of Service
By enrolling in lessons at esotera guitar academy (“esotera”), clicking “I Agree”, or entering esotera.music, you (or your parent/guardian if the student is under 18) acknowledge and agree to be bound by the following terms, conditions, and policies.
1. Attendance & Cancellation Policy
At esotera, we believe that consistent attendance is the foundation for musical progress. To ensure fairness and respect for everyone’s time, please review our attendance and cancellation guidelines below.
Cancellations:
Advanced Notice: If you cancel 24 hours or more in advance, you will receive a make-up lesson credit.
Same-Day Notice: If you cancel on the same day, you will not be able to change your lesson time and will be billed for the missed lesson. In this case, you will receive a custom lesson video from your instructor instead of a live session.
No-Shows: No-shows (missing a lesson with zero notice given) will result in the lesson and the lesson credit being completely forfeited.
Make-Up Lessons:
Make-up credits may be scheduled at a mutually agreed-upon time via our scheduling system.
Make-up credits cannot be transferred to other students or refunded for cash.
Academy Attendance Expectations:
Lessons are scheduled and committed to on a strict weekly basis.
Students are expected to attend consistently. Lessons may not be taken on an “as-needed” or drop-in basis.
Teacher Cancellations:
If an instructor must cancel a lesson, esotera will provide either a rescheduled lesson, a qualified substitute instructor, or a lesson credit.
Tardiness:
Lessons begin and end strictly at the scheduled time.
Late arrivals will result in a shortened lesson time; missed time due to student lateness cannot be made up or extended.
Special Circumstances:
In verified cases of severe illness, emergency, or unexpected major events, esotera may make scheduling accommodations at our sole discretion. Please notify us as soon as humanly possible if you are unable to attend.
2. Lesson Subscription & Cancellation Policy
To ensure fairness to both our professional instructors and other students on our waiting list, esotera enforces the following subscription guidelines:
Cancellation Notice Required: If a student wishes to withdraw from lessons and terminate their subscription, esotera requires two (2) weeks’ notice prior to cancellation. This notice period allows our academy to fill the reserved lesson time block with another student.
Failure to Provide Notice: If proper two-week notice is not provided, the student will be automatically charged for two (2) additional weeks of lessons. These charges are non-refundable and will be collected through the student’s established payment method.
3. Financial & Auto-Pay Policies
Lesson Payments: Lessons are paid for in monthly blocks. The number of lessons billed each month corresponds directly to the number of scheduled lesson days on the calendar in that specific month. Most months include four (4) lessons; some months include five (5) lessons.
Auto-Pay Enrollment: All regular lesson payments are collected through automatic withdrawal. By enrolling, the student (or parent/guardian) provides explicit consent for recurring automated payments.
Refunds: All lesson payments are strictly non-refundable. Payments cannot be transferred, credited toward other programs, or applied to future seasonal sessions once purchased. The only exception to this rule is a verified internal billing error (such as an accidental duplicate charge), in which case esotera will issue a swift correction or refund.
4. Comprehensive Liability Waiver & Release
Release of Liability
The student and/or parent/guardian hereby releases, waives, and discharges esotera, its owners, directors, employees, independent contractors, instructors, affiliates, and representatives (collectively “Released Parties”) from any and all claims, demands, actions, or causes of action arising out of or related to participation in lessons, classes, or activities conducted by esotera. This comprehensive release includes, but is not limited to, claims involving:
Teacher behavior, language, or conduct (including allegations of inappropriate, offensive, or unprofessional actions).
Allegations of misconduct, including but not limited to sexual misconduct or harassment.
Dissatisfaction with instruction, student progress, lesson quality, or overall educational outcomes.
Financial policies, including payments, refunds, cancellations, or billing disputes.
Emotional distress, reputational harm, or other non-physical damages.
Personal injury, accidents, or property damage occurring during lessons, whether in person or online.
Assumption of Risk
The student understands and accepts that participation in music lessons involves inherent risks, including but not limited to dissatisfaction with outcomes, disagreements with teachers, technical issues during online lessons, or accidents that may occur during instruction. The student voluntarily assumes all such risks.
No Guarantees
esotera makes no guarantees regarding individual student progress, skill development, or specific career outcomes from lessons. Results depend heavily on the student’s personal practice, effort, and daily engagement.
Recording & Media Consent
Students and guardians acknowledge and agree that lessons may be recorded for educational, administrative, or internal quality-assurance purposes. By enrolling, students and/or guardians consent to such recordings and waive any right to pursue claims arising from the creation, use, or distribution of recorded materials within the esotera platform.
Binding Effect
This waiver and release is fully binding upon the student, their parents/guardians, heirs, executors, administrators, and assigns.
